What This Policy Covers

This policy explains how FranConnect, LLC collects, uses, and protects information about people who visit our website or reach out to us about our products and services, such as prospective customers and leads.

This policy applies to individuals in the United States, the European Union, the United Kingdom and Switzerland. Residents of other countries who interact with FranConnect should contact us directly at privacy@franconnect.com for information about how their personal information is handled.

Important: what this policy does NOT cover: This policy does not apply to personal data that FranConnect processes on behalf of its customers in connection with the delivery of our software products and services (including FC Sky, World Manager, and RizePoint). When FranConnect processes personal data as a service provider or data processor acting on behalf of a customer, that processing is governed exclusively by the written agreement between FranConnect and that customer, including the applicable Data Processing Agreement (DPA). If you are an end user of a FranConnect customer’s platform, please contact that customer directly regarding how your personal data is handled.

What Information We Collect and Why

When you contact us or request a demo, we collect your name, email address, and phone number. We use this information to:

  • Respond to your inquiry
  • Follow up about our products and services
  • Send you relevant marketing communications

That’s it. We don’t collect any other personal information through our website.

Cookies and Tracking

Our website uses Cookiebot to manage cookies. The experience you see depends on where you are:

EU UK and Switzerland: We ask for your consent before any non-essential cookies are set. You can accept all, decline all, or choose by category.

California: A banner gives you the option to opt out of non-essential cookies. If your browser sends a Global Privacy Control (GPC) signal, we automatically honor it and suppress all non-essential tracking before the page loads.

Other US states: No active banner, but you can manage your preferences any time via the “Manage Cookies” link in our website footer. GPC signals are honored.

We Don’t Sell Your Information

We do not sell, rent, or share your personal information with any third party for their own marketing purposes. Ever.

Third-Party Service Providers

We share your information only with vendors who help us run our business, such as our CRM, email platform, and hosting provider (Amazon Web Services). These vendors can only use your data for the specific task we hired them for. Our full list of sub-processors is at trust.franconnect.com.

How Long We Keep Your Information

We keep your information for up to 24 months from your last interaction with us. After that, it is securely deleted. You can request deletion at any time.

Your Rights

Depending on where you live, you have the right to:

  • Access: see what information we hold about you
  • Correct: fix anything that is inaccurate
  • Delete: ask us to remove your information
  • Opt out: stop receiving marketing communications, or turn off non-essential cookies via the Manage Cookies link
  • Non-discrimination: we will never treat you differently for exercising these rights
  • Data portability: receive a copy of your data in a usable format (EU/UK/Swiss residents)

To make a request: email privacy@franconnect.com or write to us at the address below. We will respond within 45 days (or let you know if we need up to 90 days).

California residents may also designate an authorized agent to make a request on their behalf.

EU, UK and Switzerland: Additional Information

Why we process your data: We rely on legitimate interest and pre-contractual steps to respond to your inquiry, and on your consent to send marketing communications or set non-essential cookies. You can withdraw consent at any time without affecting anything done before withdrawal.

Transfers to the US: Your data is processed in the United States. We rely on the EU-U.S. Data Privacy Framework (EU-U.S. DPF),the UK Extension to the EU-U.S. DPF and the Swiss-US DPF as the legal basis for that transfer, supported by Standard Contractual Clauses where required for sub-processors.

Complaints: You have the right to contact your local data protection authority. You can also use our independent recourse mechanism; see the DPF section below.

Data Privacy Frameworks

FranConnect complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. FranConnect has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF. FranConnect has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.  If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles (DPF Principles), the Principles shall govern.  To learn more about the Data Privacy Framework Program (DPF Program), and to view our certification, please visit https://www.dataprivacyframework.gov/

Pursuant to the DPF Program, EU, UK and Swiss individuals have the right to obtain our confirmation of whether we maintain personal information relating to you in the United States. Upon request, we will provide you with access to the personal information that we hold about you. You may also correct, amend, or delete the personal information we hold about you. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data transferred to the United States in reliance on the DPF Program should direct their query to privacy@franconnect.com. If requested to remove data, we will respond within a reasonable timeframe. We will also provide an individual opt-out choice, or opt-in for sensitive data, before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized. To request to limit the use and disclosure of your personal information, please submit a written request to privacy@franconnect.com. 

If you are an EU, UK or Swiss Individual, where we transfer your personal data to third party service providers who perform services for us or on our behalf, we are responsible for the processing of that data by them and shall remain liable if they process your personal data in a manner inconsistent with the DPF Principles, unless we prove that we are not responsible for the event giving rise to the damage. 

In compliance with the DPF Principles, FranConnect commits to resolve DPF Principles-related complaints about your privacy and our collection or use of your personal information. EU, UK and Swiss individuals with inquiries or complaints regarding our handling of personal data in reliance on the DPF should first contact FranConnect at: privacy@franconnect.com.  

FranConnect has further committed to refer unresolved DPF Principles-related complaints to a U.S.-based independent dispute resolution mechanism, BBB NATIONAL PROGRAMS. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed by us, please visit www.bbbprograms.org/dpf-complaints for more information and to file a complaint. This service is provided free of charge to you. 

If your DPF complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. FranConnect is subject to the enforcement authority of the U.S. Federal Trade Commission (FTC). In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

If we make material changes, we will update the “Last Updated” date at the top and post the revised policy on our website.
